Dear Marine Management Organisation,

I am writing to make a formal request for information held by the Marine Management Organisation (MMO) regarding the ongoing redetermination of the marine licence to dispose of material dredged from the River Tees Estuary and Hartlepool Harbour at sea (the Licence) , as agreed in the consent order approved by Mrs Justice Lang on 2 March 2026.

Please provide copies of all information, records, and communications held by the MMO created or received within the last 4 months (spanning from 1 February 2026 to the date of this request), specifically covering the following areas:

1. Correspondence: All emails, letters, and written communications in any form (including attachments, internal memos, and notes) exchanged between the MMO, PD Ports (the Statutory Harbour Authority, including their agents/consultants), and/or the Centre for Environment, Fisheries and Aquaculture Science (Cefas) regarding the Licence redetermination process or sediment characterization requirements for the River Tees.

2. Draft Sampling and Analysis Plans (SAPs): Any draft or final sediment sampling plans, grid layouts, station maps, or instructions issued by or submitted to the MMO or Cefas regarding required sediment testing frequencies, locations, and depth criteria for the River Tees dredge areas.

3. Meeting Minutes and Notes: Agendas, official minutes, action logs, and handwritten or typed notes taken during any virtual or in-person meetings or telephone calls between the MMO, PD Ports, and/or Cefas concerning the Licence redetermination.

4. Internal Briefings: Any internal notes, briefings, technical assessments, analysis, or directives concerning the spatial sampling criteria required to achieve OSPAR compliance for the Licence redetermination.

Framework for Disclosure

As this request explicitly concerns administrative measures, plans, and activities affecting or likely to affect the state of elements of the environment (specifically marine sediments and estuarine waters), it falls strictly within the definition of “environmental information” under Regulations 2(1)(b) and 2(1)© of the EIR.

As you are no doubt aware, under the EIR framework: • Public authorities must apply a robust presumption in favour of disclosure (Regulation 12(2)). • Information relating to emissions into the environment cannot be withheld using exceptions contained in regulations 12(5)(d)-(g), which includes confidentiality exceptions (regulation 12(9)). “Emissions” is to be given its natural meaning and will include: • the by-product of an activity or process; • that is added (or potentially added) to and affects the elements of the environment; • over which any control is relinquished.

Sediment from dredging and disposal activities clearly falls within this definition.

If any element of this request is deemed to fall under an exception, please separate that material and release all other segregable, non-exempt parts of the records. If any portion is withheld, please specify the exception relied upon, how it applies and how the public interest favours withholding the information (if applicable).

Good morning MMO,

I hope you're keeping well and thank you for sending over the information and link. We've taken the time to review the comms internally and have a few observations to share.

Firstly, the year mentioned in the second paragraph appears to be incorrect. It currently states: “On 27 May 2026 PD Teesport submitted an application (MLA/2025/00263) to the MMO for a marine licence to continue to undertake disposal of dredged material from maintenance dredging of navigable channels and berths within The Tees and Hartlepool.”

With regard to the quantities, these are fine — just presented differently. The first paragraph refers to the total per year, and the second breaks it down into silt and sand components. Both add up to 2,889,700 wet tonnes per annum, so there's no discrepancy there, but uniform display of information will remove any confusion.

I have spoken with the national ports lead who has given the area team a heads up a request will be incoming. I have copied the information NE provides to all in relation to MDPs below:

Natural England continues to support the production (including reviews) of Maintenance Dredge Protocols(MDP) as industry best practice, providing a foundation for consistent and informed decision making by all competent authorities. The MDP provides a strategic approach to considering the impacts of maintenance dredge activity within a defined port or estuary and can support demonstration of compliance with The Conservation of Habitats and Species Regulations 2017 as amended (The Habitats Regulations). It also negates the need to produce an environmental assessment for individual consent applications, thereby providing efficiencies through the consenting process. This enables a clear baseline and audit trail for compliance with the Habitats Regulations to support dredging activities (and any potential marine licence applications as required) for all statutory harbour authorities in the area.

With regard to the below, I have the following comments and feedback:

• Is consultation with Natural England (NE) through the Discretionary Advice Service (DAS) and EA prior to application a legal requirement?
  • No, this is heavily encouraged to reduce the risk and be able to defer to the MDP. This helps the process timeline as we can rely on the MDP and its conclusions confidently. If consultation hasn't been undertaken prior to submission there will likely be multiple rounds of consultation which is a risk to the timeline.
• Can consultation detailed below with NE and/or the Environment Agency (EA) take place during the application process, or is it expected that consultation and feedback are completed beforehand?
  • It is expected by all that consultation would be undertaken beforehand. If this is not done the MDP is not a statutory requirement therefore NE/EA may not comment fully on the document and just advise in relation to the open application and may require more information which would lead to further consultation rounds prior to determination.
• Are you able to provide contact details for the NE Head of Ports? Given the complexity and focus of this case, it would be useful to speak directly to understand their current position and to begin building a relationship early in the process.
  • Yes this is REDACTED.
• The MMO Marine Licence application process has clear milestones in terms of stages and timings, and I am concerned that introducing additional consultation or processes outside of this framework may add delay to an already tight timeframe.
  • This is understood, please note the risk above that may add additional consultation requirements during the licensing process.
• My understanding is the MMO will consult with NE and EA as part of the Marine Licence consultation stage, if prior consultation has taken place, I'm assuming this will not be repeated as part of this process.
  • We will still have to consult NE and EA in case anything else is highlighted but this should be a quicker process and would hopefully not identify any new issues that haven't been resolved through the MDP.
• I understand we should expect written feedback from the MMO this week regarding the EIA Screening Documentation, along with information on the expected cost of Marine Licence reapplication.

I am reaching out regarding our re-application for the Tees and Hartlepool Maintenance Dredge Disposal licence. We are keen to get the ball rolling, so could you please advise at your earliest convenience on the following points:

Firstly, when can we commence the application process? Is there a specific start date or timeframe we need to adhere to?

Secondly, do we need to start the application from scratch, or can we use our previous application as a baseline? A lot of the information remains unchanged, and it would be highly beneficial if we could build upon the previous submission.

Could you also confirm the application process and what specific information you require from us? Understanding this in detail will help us prepare thoroughly and ensure we meet all the necessary requirements.

Lastly, for the licence application, could you clarify what additional information you require this time around compared to our previous submission? This is crucial for us to grasp the resource requirements and associated timescales, allowing us to plan accordingly. We need to know at the earliest opportunity if an EIA is required, and if so, what is expected with regards to contents. We have taken advice and we have been advised this may take a large period of time so this needs to commence at the earliest opportunity to avoid any delay in application.

We would like to clearly understand the process and what is expected of us at the start of the application

Maintaining this Marine Licence is critical to our operations so we are treating this re-application as a priority.

We have nine months until the licence is quashed, the MMO is treating this case as a priority. I have written next steps below on what is required:

1. PD ports to submit EIA screening request on MCMS - under Schedule A2, Paragraph 76 - Sludge-deposition sites of the Marine Works Regulations 2007. This can be submitted as soon as you have the information required. Please let me know when submitted on MCMS so this can be allocated to the case team as a priority.
2. MMO Case team to process and issue EIA screening opinion - this can take between 8-1 2 weeks but will be worked on as a priority.
3. PD ports to submit new MLA on MCMS, once EIA screening opinion is issued.
4. MMO Case team to process the MLA - we expect increased consultation responses and will liaise closely during the process to provide indicative timescales. Again please let me know when this is submitted on MCMS so this can be allocated to the case team as a priority.

The EIA screening request should include:

• a chart or map (or both) sufficient to identify the location of the project and of the regulated activity;
• a description (including a plan) must include the physical characteristics of the project (including information on the size, scale, nature, timescale, working methods and duration of the project) and, where relevant, of demolition works;
• a description of the location of the project, with particular regard to the environmental sensitivity of geographical areas likely to be affected;
• a description of the aspects of the environment likely to be significantly affected by the project;
• a description of any likely significant effects of the project on the environment, to the extent of the information available on such effects resulting from:
• the expected residues and emission and the production of waste, where relevant
• the use of natural resources, in particular soil, land, water and biodiversity; and such other information or representations as the applicant may wish to provide, including a description of any features of the project or measures envisaged to avoid or prevent what might otherwise be significant adverse effects on the environment (mitigation measures).

Please also take into account the grounds set out within the challenge as part of this information and for any updated MLA.

You will be able to utilise the information from your original application within the new application with any additional information which will hopefully reduce your workload.

We would be happy to arrange bi-weekly keep in touch calls throughout the process to provide updates if you feel this would be beneficial.

Are you expecting us to submit another sample plan or conduct additional samples that are over and above what was submitted in the original application? We are currently reviewing the sample requirements in more detail from the information within the challenge.

The samples which were previously conducted still stand with regards to this new application. However, after our review more samples may be required and these will be in addition to the ones you have provided, the likelihood is no sample plan will be required as we will advise on the back of our discussions the requirements. Analysis would be required for new samples.

We are content for the EIA to be submitted as soon as possible and further discussion on samples (if required) can take place once we have an update prior to/as part of the MLA.

Thanks for the submission, this will be allocated as soon as estimate is accepted.

In terms of meetings, lets set something up for 2 weeks' time and then on going, as mentioned last time, if we don't need it, we can cancel on a particular week, but best to have it in the diary.

In terms of sampling, we are still discussing internally but will let you know asap. I have discussed with management, the MMO engagement with BLACKBOX and at this stage whilst we think it could be good for yourselves to engage and discuss issues that are likely to come up, and earlier is always better than later, the MMO is only likely to attend in a listening capacity and not dictate what is required or agree to mitigation for example in this forum. Of course, its up to yourselves how you engage outside of formal public consultation, but there could be benefits.

Of course, the MMO view on this may change depending how things progress, but I wanted to update you on our current thinking of this.

We may discuss this at a later date.

Reaching out with some possible days and times to set up a recurring meeting. We find setting up a recuring meeting with the same day and time works best for us. This does mean that we may not all be able to attend every meeting but will always pass on any information to those attending if we are unable to make a meeting. Here is our current suggested days and times:

• Tuesday 9am to 1 0am and 1 2pm to 3pm
• Thursday 9am to 1 0am and 1 2pm to 2pm

Since we received the EIA last week we would be looking to start the meetings the week of the 20th April however it is likely we may not have any updates by then but we are happy to start.
